DPIA Requirements
The conditions under the GDPR that determine when a Data Protection Impact Assessment is mandatory, namely when a processing activity is likely to result in a high risk to individuals' rights and freedoms.
DPIA requirements define the trigger: the GDPR mandates a DPIA before processing that is likely high-risk, such as large-scale processing of sensitive data, systematic monitoring, or automated decisions with significant effects. Knowing the criteria lets an organization recognize when an assessment is legally required rather than optional. Misjudging this, skipping a DPIA where one is required, is itself a compliance failure, so the requirements are the gate before the DPIA process.
Introduced in: Privacy Law and GDPR Practice
Examples
- Recognizing that large-scale processing of sensitive data triggers a DPIA.
- Requiring a DPIA before deploying systematic monitoring of individuals.
- Determining a DPIA is mandatory for an automated decision-making system.
